Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Nerdy Popcorn, you agree to these Terms of Service. If you do not agree, do not use the app.

2. What Nerdy Popcorn Is

Nerdy Popcorn is an IPTV player application that plays video streams from sources you provide, manages VOD libraries from your sources, and can sync selected setup information, watch progress, favourites, and preferences when enabled.

Nerdy Popcorn does not provide content, include pre-loaded streams or channels, facilitate access to copyrighted content you do not have rights to, or store or host media files.

3. Your Responsibility

You are responsible for ensuring you have legal rights to all content you stream, complying with all local laws regarding streaming, obtaining necessary licenses or permissions from content providers, protecting your IPTV credentials, and not using the app for copyright infringement or piracy.

We are not responsible for what content you stream, whether your sources are legal, copyrights or licensing of streams, ISP throttling, or ISP penalties.

4. Prohibited Uses

You agree not to use Nerdy Popcorn to stream copyrighted content without authorization, distribute pirated media, circumvent copyright protections, violate laws, harm or exploit children, harass or threaten others, or distribute malware or viruses.

Violation of these terms may result in account suspension or termination and, where appropriate, legal action.

5. Intellectual Property

You retain your rights in content and data you provide. We own Nerdy Popcorn's code, design, and trademarks. You may use the app for personal, non-commercial use only and may not unlawfully copy, modify, or distribute it.

6. Cloud Sync & Managed Setups

Cloud features may include recent-channel sync, watch-progress sync, favourites, app settings, device groups, and managed setup packages. IPTV credentials are stored in the cloud only when you deliberately save or attach a managed setup through the account console.

You can disable optional sync features and remove devices or setups through the available account controls. Reasonable technical and size limits may apply.

7. Device Compatibility

Nerdy Popcorn is designed for supported Android TV and Fire TV devices. We do not guarantee compatibility with every model, operating-system version, or codec.

We are not responsible for hardware incompatibilities, performance issues on unsupported devices, or audio/video codec limitations of your device.

8. Service Availability

We work to keep the service available but do not guarantee uninterrupted operation. We may perform maintenance, address security issues, modify features, or suspend access where these terms are violated.

9. Disclaimer of Warranties

Nerdy Popcorn is provided "AS IS" without warranties. We do not guarantee uninterrupted service, specific performance or results, freedom from bugs or errors, that streams will work, or that all audio codecs are supported.

10. Limitation of Liability

To the fullest extent allowed by law, we are not liable for lost data or recordings, lost revenue or profits, unauthorized access to your streams, third-party content or services, or your IPTV provider's actions.

To the extent permitted by applicable law, our total liability will not exceed the amount you paid to Nerdy Popcorn during the six months before the event giving rise to the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless Nerdy Popcorn from copyright or intellectual property infringement claims related to content you stream, your violation of these terms, your violation of laws, and disputes with your IPTV provider.

12. Subscription, Billing, and Cancellation

Nerdy Popcorn offers monthly access, annual access, and Lifetime Access while available. Eligible Founding pricing may be applied with a valid promo code at checkout. Each paid plan provides access for up to five activated household devices unless a different device limit is shown at checkout. The final price, currency, tax, and any other amount will be shown before you complete payment.

Monthly and annual subscriptions renew automatically through Stripe until cancelled. You can manage your payment method, invoices, and cancellation from Account Settings on NerdyPopcorn.ca. Secure billing actions open a Stripe-hosted billing page. Cancellation stops future renewals and access continues through the end of the paid billing period unless applicable law requires otherwise.

Lifetime Access provides Premium access for the supported lifetime of the Nerdy Popcorn product. Individual third-party APIs, integrations, and data sources may be replaced, modified, or discontinued if they become unavailable. Your underlying Premium entitlement will remain active. Lifetime Access is a one-time purchase and does not renew.

Lifetime Access refunds are available for 30 days after purchase. To request a refund within that window, email billing@nerdypopcorn.ca with the account email used at checkout. After 30 days, Lifetime Access purchases are non-refundable except where required by law.

Activation codes and paid access are for personal household use. You may not resell, rent, commercially share, or publicly distribute your account, activation codes, or device access.

We may send service emails about activation codes, upcoming renewals, payment failures, cancellation, refunds, or other material subscription events. Contact billing@nerdypopcorn.ca promptly about billing errors or refund requests.

13. Suspension and Termination

We may suspend or terminate access if you violate these terms, use the service illegally, abuse the service or support team, fail to pay applicable fees, or threaten the security of the service. You may request account closure through support.

14. Governing Law

These terms are governed by the laws of Ontario and the applicable federal laws of Canada. Before starting a formal dispute, please contact us so we can try to resolve it.

15. Changes to Terms

We may update these terms at any time. Material changes may be posted in-app or sent by email. Continued use means acceptance.

16. Severability

If any term is invalid, the remaining terms stay in effect.

17. Entire Agreement

These terms plus the Privacy Policy are the entire agreement between us regarding Nerdy Popcorn.
